ADEBUKUNOLA ADEOTI BANJOKO, JCA (DELIVERING THE LEADING JUDGMENT): This is an Appeal against the Ruling of the Federal High Court, Abuja Division, delivered by Honourable Justice B. O. QUADRI in Suit No: FCT/ ABJ/CS/319 /2016 on the 4th of July, 2018 which can be seen at Pages 523 to 547 of the Records of Appeal.
The Appellants, as Plaintiffs had approached the Trial Court, vide an Amended Originating Summons filed on the 19th day of December, 20 l 6, and had sought for the determination of the following Questions:
i. Whether the 1st Defendant has the powers under Section 7 of the Company and Allied Matters Act, 1990 (As Amended) to cancel and expunge documents it accepted, verified, processed, and registered on the ground of lis pendis, suo motu, on an issue different from the issue pending before the Court or on any grounds whatsoever?
