UWANI MUSA ABBA AJI, JCA (Delivering the Leading Ruling): This is an appeal against the Ruling of Hon. Justice L.H. Gummi; Hon. Chief Judge of the Federal Capital Territory Abuja delivered on the 27th February, 2007 upon a point of law raised suo motu by his lordship during the cause of trial at the court below.
By a Writ of Summons dated the 1st day of August, 2001, the Appellant as the Plaintiff at the court below instituted this suit against the Respondent who was also the Defendant at the trial court and claimed as per paragraph 40 of its Amended Statement of Claim as follows:-
