ABBA BELLO MOHAMMED, JCA (Delivering the Leading Judgment): This is an appeal against the Ruling of the High Court of the FCT, Abuja on a motion for stay of further execution and the garnishee proceedings, delivered on the 5th of December, 2023 by Hon. Justice J. Enobia Obanor. The Ruling is contained at pages 555 – 559 of the Record of Appeal. Dissatisfied with the Ruling, the Appellants filed this appeal vide Notice of Appeal filed on the same 5th December, 2023, which is at pages 562 – 570 of the Record of Appeal.
In furtherance of the appeal, the Appellants filed a Brief of Argument on the 6th of June, 2024, which was deemed properly filed on 28th November, 2024. As for the 1st Respondent, a 1st Respondent’s Brief of Argument, along with a Notice of Preliminary Objection were filed on 21st January, 2025. The 4th Respondent also filed its Brief of Argument on the 26th of November, 2024.
