Plaintiffs are heads of Nii Sanshie family of Nungua and Wala Odai family of Nungua respectively. They sued for themselves and on behalf of their respective families. Plaintiffs sued Defendants jointly and severally for declaration of title to 49.985 acre land, Accra and 14.872 acre land, Accra which lands are situate and lying at North West Nungua respectively, among the usual ancillary reliefs of recovery of possession, damages for trespass and perpetual injunction.
Plaintiffs claimed they derived their respective interests or title to these lands from the Nungua Stool. They alluded to indentures dated 5th June 1962 and 1st June 1962 respectively as documents evidencing their ownership of the lands. They claim the lands adjoin each other and they are at one of the Nungua villages called Washegba otherwise popularly called Okpoi Gonno.
