TINUADE AKOMOLAFE-WILSON, J.C.A. (Delivering the Leading Judgment): This is an appeal against the Judgment of the High Court of The Federal Capital Territory Abuja Delivered on 28th of October, 2010 by Hon. Justice Jamilu Y. Turkur; wherein the respondent was claiming title to the piece of land plot No-452 located at Kubwa Extension 11 layout in Bwari Area Council of Federal Capital Territory.
The appellant after being served with the writ of summons filed a statement of defence disputing the claim of the respondent and equally filed a counter-claim against the respondent in respect of same piece of land in the same location.
The Trial Court delivered its Judgment and conferred title to the said plot in dispute on the respondent. It is against the said judgment that the Appellant filed a notice of appeal to this Honourable Court dated 27th January, 2011 (pages 131-134 of the record of appeal).
