The Plaintiff, a limited liability company registered in South Africa claimed against the 1st Defendant, a gold refinery company registered in Ghana and its 4 directors and shareholders, the 2nd, 3rd, 4th and 5th Defendants jointly and severally, the following reliefs:

a) Repayment of the debt in an amount of $8,667,493.01

b) Payment of accrued interest and default interest in the amount of $132,211.25

c) Payment of interest at the publicly quoted prime interest rate of the US Federal Bank plus 2% calculated and compounded from 25th May 2014 until the date of final payment of the debt.

d) Payment of default interest at the publicly quoted prime interest rate of the US Federal Reserve Bank plus 5% compounded from 25 May 2014 until the date that it is actually paid.

e) An order for the appointment of a Receiver to sell the assets and shares in the 1st Defendant charged by the Mortgage, Fixed Charge and Share Charge and to receive any monies receivable as a result of the sale.
