JUDGMENT
OCRAN, J.
On 5th August 2011, the plaintiffs issued out this writ against the 1st defendant and claimed some reliefs.
On 1st September 2011, the defendant entered appearance to the plaintiffs’ writ of summons and filed a defence to the action on 27th September 2011. After pleadings had closed, the issues filed by the plaintiffs were set down on 23rd January 2012 as the issues for trial, on the premise that no additional issues had been filed. However, it appeared that on the same 23rd January 2012, the then defendant filed additional issues but this was not brought to the notice of the then trial judge
The issues set down on 23rdJanuary 2012 for resolution are as follows:
a) Whether or not the land subject-matter of this dispute originally formed part of Prampram stool land.
b) Whether or not Prampram stool leased the land in dispute to Justiny Company Ltd
c) Whether or not Justiny Company Ltd assigned the land to 1st plaintiff herein
