ONNOGHEN, JCA (Delivering the Lead Judgment): This is an appeal against the ruling of Hon. Justice S. B. Oyewole of the Ekiti State High Court of Justice holden at Ikole-Ekiti State in suit No. HCL/29/95 delivered on 15th March, 2001.
The facts of the case include the following: On the 5th day of September, 1995 the plaintiffs, now respondents caused a writ of summons to be issued to the appellants claiming a declaration that the 24th February synod meeting of the 1st appellant was illegal; annulment of the appointments made thereat; an order that the Will of the late founder of the church is not binding on the church; an order that appellants should not disturb respondents and other officiating members in the headquarters branch of the church; an order on the 7th appellant to hand over church property with her to the superintendent of the church and an order restraining appellants from harassing respondents and other members of respondents’ faction.
