SAIDU TANKO HUSSAINI, JCA (Delivering the Lead Ruling): Pursuant to leave sought and granted by the order of this Court made on 20th October, 2014 in the Motion in Appeal No. CA/PH/534/2014 the Appellant/Respondent filed a Notice of Appeal on 28th October, 2014 and a brief of argument in Appeal No. CA/PH/6/2015 between Registered Trustees of Assemblies of God Mission v. Juliet Ekpo Tort.
The Applicant who felt she was not given any hearing in the proceedings leading to the ruling granting the Respondent an extention of time to file Notice of appeal in Appeal No. CA/PH/6/2015 by the Application made on her behalf and filed on the 8th December, 2014 sought to have the entire proceedings of the 20th October, 2014 set aside including the ruling of this Court but the Court in another considered ruling delivered on the 21st October, 2015 in Appeal No. CA/PH/534M/2014 refused that application and dismissed same.
