FREDERICK OZIAKPONO OHO, J.C.A. (Delivering the Leading Judgment): Before the High Court of Abia State sitting at ABA, in suit No. A/106/2007 the Claimants/Appellants brought an action against the Respondents claiming as per paragraph 25 of their Statement of Claim the following reliefs:
1. A Declaration that the demolition of 531 sheds of the Plaintiffs at Ariaria International Market, Aba by the Defendants is illegal, unlawful and in violation of the Order made by the High Court of Abia State on the 5th day of August, 2006 in suit No. A/162/2006 between the Registered Trustees of Timber Dealers Association v. Anthony Ngoesina and 3 Ors.
2.
