MUHAMMAD IBRAHIM SIRAJO, JCA (Delivering the Leading Judgment): This is an appeal against the decision of the High Court of Rivers State, Port Harcourt Judicial Division, delivered on the 6th day of October, 2020 in Suit No. PHC/1501/2009 by Honourable Justice A. Enebeli, wherein judgment was entered in favour of the 1st Respondent. Before the lower Court, the 1st Respondent, as Claimant, initiated the suit against the Appellant and the 2nd Respondent who were 1st and 2nd Defendants respectively, vide a Writ of Summons, copied at pages 1-10 of the Record of Appeal. In its Further Amended Statement of Claim dated 18th October 2017, the 1st Respondent sought for the following reliefs jointly and severally against the Defendants as follows:

1. A Declaration that the contract of service/employment and/or recruitment between the Claimant and KADIRVELU VARADHARAJA PERUMAL for the benefit of the 1st Defendant is a valid and binding contract.
