J U D G M E N T
The first accused is a hairdresser and a national of Uganda and the second accused a businessman and a national of Nigeria. In count 1 they are charged with Conspiracy to import a narcotic drug without license issued by the Minister for Health contrary to Sections 23 (1) of the Criminal Offences Act 1960 (Act 29) as amended by the Criminal Offences (Amendment) Act 2003 (Act 646) and Sections 1(1) and 56 (c) of the Narcotic Drugs (Control, Enforcement and Sanctions) Act 1990) (PNDC Law 236). In count 2 they are jointly charged with Importation of a Narcotic Drug without license issued by Minister for Health Contrary to Section 1(1) of the Narcotic Drugs (control, Enforcement and Sanctions) Act 1990 (PNDC Law 236). Then in count 3 they are jointly charged with possession of Narcotic Drugs contrary to Section 2 (1) of the Narcotic Drugs (Control, Enforcement and Sanctions) Act 1990 (PNDC Law 236).
