MUHAMMED LAWAL SHUAIBU, JCA (DELIVERING THE LEADING JUDGMENT): This appeal is against the judgment of High Court of Justice, Rivers State, sitting in Port Harcourt Coram: Hon. Justice T. S. Oji delivered on the 30th day of June, 2020, wherein the Claimants’ claim was dismissed, while granting the reliefs in the counter- claim.
By an amended writ and statement of claim filed on the 11th February, 2016, the Appellants as Claimants in Suit No. AHC/62/2010 claimed against the Defendants now Respondents as follows:
1. A Declaration that the purported sale of part of Ukpeli-Ogba land, situate along East-West road, Okogbe Town, Ahoada West Local Government Area, Rivers State, Nigeria by the 1st to 6th Defendants to the 7th Defendant without the consent and concurrence of the Claimants is illegal, null, void and of no effect whatsoever.
