SAULAWA JCA (Delivering the Lead Ruling): It is instructive that on 28 August 1990, the respondents filed a suit No. PHC/433/90 in the Rivers
State High Court, Port Harcourt Judicial Division, seeking the following reliefs against the respondents:
A declaration that the plaintiffs are the owners of and entitled to the statutory right of occupancy over and in respect of a piece or parcel of land known as “Okporo Woli” situate at andlying along Okohia Street (which parcel of land including a buildingerroneously described as No. 4B Okohia Street) Diobu, Port Harcourt. The exact extent of the said land will be shown on a survey plan to be filed later. A declaration that the purported sale of the said land or any portion of it by the 2nd defendant to the 1st defendant is null and void and of no effect whatsoever. An injunction perpetually restraining the defendants, their agents and servants from further interfering with the plaintiffs’ ownership, possession or use of the said land.
