(Delivering the Leading Judgment): By an Amended Information with proof of evidence filed on 12th December, 2008, the Appellant, together with four others, to wit; APOSTLE GONEE, LENEE OKERE, KINDOM OKERE and GOODLUCK OKERE and others now at large were charged before the High Court of Rivers State, Bori Judicial Division, M. O. OPARA J. presiding with the following offences:-
STATEMENT OF OFFENCE
CONSPIRING TO MURDER, contrary to Section 324 of the Criminal Code Law (Cap. 37) Laws of Rivers State of Nigeria 1999.
PARTICULARS OF OFFENCE:
BARIDOSA ROBERT, APOSTLE GONEE, LENEE OKERE, KINGDOM OKERE, GOODLUCK OKERE, GODFREY GBENEE TEE-BEKE and others now at large on the 3rd day of December, 2006 at Baa-Lorre Community in the Bori Judicial Division, did conspire to kill Apostle Elijah Okeeke Andrew.
