Plaintiffs’ Case
The plaintiff refers to herself as the administratrix of the estate of her deceased daughter Florence Ayitey who died intestate on 17th August 2004. It is the plaintiff’s case that the said Florence Ayitey in her lifetime, on or about the 24th day of October 2002, purchased two plots of land identified as Block 53, plots 5 and 6 from the defendant Company at a cost of Forty Two Million Five Hundred Thousand Old Cedis (₵42,500,000.00) now Four Thousand Two Hundred and Fifty Ghana Cedis (GH₵4,250.00), which she fully paid for. She further paid an amount of Five Hundred United States Dollars (US$500) for provision of electricity to the site. The plaintiff asserts that the above payments represent the total payment her daughter had to make to the defendant and she was never required to make any further payments in respect of the properties.
