JUDGMENT OF THE COURT
This is yet another high profile succession cause in which the beneficiaries of the estate are mired in the miasma of familial rancour. As recently as 24th November 2017, this Court made the following observation in the case of Margaret Njeri Mbiyu v. David Njunu Mbiyu Koinange and 13 Others Civil Appeal No. 47 of 2016 (Consolidated with 50 and 56 of 2016) (UR):
"During his sojourn on this earth, the deceased acquired and accumulated massive wealth, particularly prime land in Kiambu, Nairobi, Nakuru and Mombasa counties, in all totalling to almost 6,000 acres worth billions of shillings. Unfortunately, that wealth has turned out to be the apple of discord in his family, as vividly demonstrated in this appeal and in the proceedings in the High Court that gave rise to it.
