JUDGMENT 

I cannot help but comment that this has been one of the most difficult cases to adjudicate, not because of its complexity, but because of the delicate relationship between the parties and the rift that this case appears to have caused in a once happy family. 

The Plaintiff, Rosemond Norteye is the older sister of the Defendant, Frank Norteye.  According to the Plaintiff, sometime in 2005 whiles she was in the United Kingdom, the  Defendant, who by then was a staff of TV3, informed her of a residential property sale arrangement between Commercial Investment Limited, a Real Estate Company and TV3  staff, to offer workers residential property on reasonable payment terms.  

She expressed interest in the sale arrangement and asked the Defendant, who also acquired  one of the houses for himself, to purchase one house in her name. She further requested that the Defendant should use her daughter, Beverly Mbroh, as her next of kin and her brother  Theophilus Norteye as her guarantor.…
