RULING OF THE COURT
The Application under consideration is brought by the ROYAL MEDIA SERVICES LTD, [hereinafter the applicant], under the provisions of Sections 3A and 3B of the Appellate Jurisdiction Act and Rules 5(2) (b) and Rule 43 of the Court of Appeal Rules to bar the COMMUNICATION COMMISSION OF KENYA, [hereinafter the 3rd respondent], and seeks the following orders:
THAT the 3rd Respondent be restrained from usurping the licensing and regulatory powers and functions of the body to be established by Parliament under Article 34(3) and 34(5) of the Constitution pending the hearing and determination of the applicant's Civil Appeal no. 43 of 2013, Royal Media Services Ltd v. The Attorney General, Minister of Information and Broadcasting and Communications Commission of Kenya.
