FASANMI JCA (Delivering the Lead Judgment): This is an appeal against the judgment of the Rivers State High Court of Justice, delivered on 19 March 2001, in suit No. PHC/2188/2001.

The 1st respondent as claimant by an amended statement of claim at thelower court, claimed againstthe appellant and the2nd - 17th respondents (as the defendants) jointly and severally as follows:

That as owner by purchase of the property now known as No. 22, Station Road, Port Harcourt, (formerly No. 13, Liberation Drive, Port Harcourt, Plot 6 Station Road Layout, Port Harcourt), heis entitled to possession, enjoyment, control and management of same.
