JAMES SHEHU ABIRIYI, J.C.A. (Delivering the Leading Judgment): This appeal is against the Judgment delivered on 14th June, 2016 in the High Court of Adamawa State holden at Yola in suit No. ADSY/98/2013.
The claim of the Respondent as plaintiff against the Appellants as defendants in the Court below was for the following:
1. A declaration that the plaintiff is entitle to all that piece of land situate and lying at Chambaji near new Polo Ground (Race Course Ground) Yola town, Yola South L.G.A, Adamawa State measuring a total area of 6.0374 hectares.
2. The sum of N2, 000, 000.00 (Two Million Naira) only as general damage for act of trespass and undue hardship the plaintiff suffer as a result of the Defendants conduct.
3. An order of perpetual injunction restraining the Defendants, their agents, Assigns, privies, and successors-in-title from further act of trespass.
4. Cost of litigation.
