(Delivering the Leading Judgment): This appeal is against the judgment of the Court of Appeal, Kaduna Judicial Division, wherein the court dismissed the appellant’s appeal against the judgment of the High Court of Kaduna State, which found the appellant, along with three other co-accused persons, guilty of conspiracy to commit armed robbery and armed robbery punishable with death and sentenced them to death by hanging.

The appellant, along with three other co-accused persons, was charged before the Kaduna State High Court with a two-count charge of conspiracy to commit armed robbery and armed robbery contrary to section 6(b) and punishable under section 1(2)(a) of the Robbery and Firearms (Special Provisions) Act, Cap. R11, LFN, 2004, respectively.
