JUDGEMENT

ADJEI, J.A.

This interlocutory appeal before this Court emanates from the ruling delivered by the High Court Accra in respect of an interlocutory injunction which restrained both parties from the land, the subject matter in dispute until the final determination of the matter. The ruling was rendered on 12th January, 2018 and the Defendant dissatisfied and aggrieved with the ruling filed an appeal against same on 30th January, 2018.

The brief facts of the matter before the High Court as disclosed by the pleadings were that the Plaintiff sued the Defendant for a declaration of title of a six acre land at Old Ningo- Larkpleku in the Ningo Prampram District, recovery of possession, damages for trespass and an order for perpetual injunction to restrain the Defendant and his agents and assigns.
