JUDGMENT 

The original defendant in this suit, Jonathan Ablorh Osekre, died in the course of proceedings. He was substituted by his daughter, Patricia Osekre, who happened to have been instrumental in the negotiation of the assignment of the land, subject matter of this dispute. 

The facts of this case are that Jonathan Ablorh Osekre, assigned a part of his  land on which he had his dwelling house to the plaintiff, Samuel Nsiah Sowah. After the plaintiff had paid the agreed purchase price of GHC20,000, the parties  executed a deed of assignment dated 4th July 2012. Thereafter, the plaintiff caused his title in the land assigned to him to be registered by the Land Title  Registration Division of the Lands Commission. Upon receipt of his land  certificate, which was issued on 7th September 2012, barely three months after the deed of assignment was executed, the plaintiff attempted to deposit stones on the land for the purpose of construction but was prevented by his assignor.
