JUDGMENT
Background
The Plaintiff’s against the Defendant arose from allegations bordering on the infringement of the registered industrial designs of the Plaintiff by the Defendant in respect of Naphthalene balls in a space were the parties are involved in the production and sale of naphthalene balls.
Accordingly per a Writ of Summons caused to be issued out of the Registry of the Commercial Court, Accra on 6th February, 2019, the Plaintiff seeks the following reliefs against the Defendant:
(a) A declaration that the Defendant has infringed the Plaintiff’s Industrial Design Number AP/D/00868.
(b) An injunction restraining the Defendant whether by itself, its servants or agents or any of them or otherwise however from doing the following acts that is to say infringing the Plaintiff’s Industrial Design No. AP/D/00868 by using or causing same to be used to manufacture and import for marketing distribution and sale in Ghana, naphthalene ball/insect repellent products or any other products.
