AKINTAN, J.C.A. (Delivering the Leading Ruling):The second appellant/ applicant, a German National, is an employee of Strabag Construction (Nigeria) Limited, a major construction company in Nigeria. The 1st appellant/applicant, also a German national, was an employee of Julius Berger Nigeria PLC., also another major Construction Company in Nigeria. But he is now said to have left the Country having completed his contract with the company. The two companies - Strabag Construction Nigeria Limited and Julius Berger Nigeria Pic. formed a joint venture known as "Joint Venture B + S" for the purpose of executing the civil engineering contract of the Aluminium plant complex being built by the Federal Government of Nigeria. Each of the applicants was respectively nominated by his company as his company's agent at the joint venture Construction site in Ikot Abasi. The respondents are natives and representatives of the local community where the plant is being built.
