BIOBELE ABRAHAM GEORGEWILL, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of Lagos State Coram: O. A. Taiwo J., in Suit No. ID/678/2007: Chief Ali Maged Taan v. SCOA Nig. Plc and Ors, delivered on 16/11/2012, in which relief (vii) in the counter claim of the 2nd and 3rd Respondents were against the Appellant.

The Appellant was dissatisfied with the said judgment and had appealed to this Court vide its notice of appeal filed on 15/21/2013 on one ground of appeal at pages 745A-745B of the Record of Appeal. The Record of Appeal was transmitted to this Court on 31/7/2013 but deemed properly transmitted on 18/11/2013. The Appellants brief was filed on 8/4/2014 but was deemed properly filed on 4/2/2015. The 2nd and 3rd Respondents' brief was filed on 23/6/2014 but was deemed properly filed on 4/2/2015. The 1st Respondent did not file any brief.
