1 Background
On 20 December 2019, the plaintiff commenced this suit by a writ of summons against the defendant for the following reliefs:
1. The payment of GH¢88,800.00 being the 60% of the profit from the contract financed by the plaintiff contained in an agreement dated 9/9/2017 signed between the plaintiff and the defendant.
2. An order for the further payment of GH¢13,929.00 also being the 60% of retention claims made on the contract financed by the plaintiff per the agreement dated 9/9/2017 between the plaintiff and the defendant.
3. A further order directed at the defendant to share the interest on delayed payment of the contract sum financed by the plaintiff per the agreement of 9/9/2017.
4. An order for interests on the sums of GH¢88,800.00 and GH¢13,929.00 from October 2019 till the date of final payment.
5. Costs including lawyer’s fee assessed at 25% of the total sum due and payable by the Defendant to the Plaintiff.
