JUDGMENT  

Plaintiff took this action against the Defendants who carry on the business of  Real Estate for an order for specific performance or in the alternative payment  of the current value of the land among others. Plaintiff said she entered into a  contract for sale with 1st Defendant (who held itself out at all times as the  beneficial owner of the land) for the purchase of 6 plots of land covering an  approximate area of 0.96 acre situate at Prampram. The total price was GH¢72, 000. Plaintiff said it was agreed that GH¢50,000 was to be paid upon execution  and the balance of GH¢22, 000 to be paid over ten months. The term of the  proposed lease was for a period of sixty (60) years with an option to renew for  a further term of thirty-nine (39) years. 

Plaintiff said she fulfilled her part of the agreement and paid all the sums due  and was receipted. Plaintiff said the final instalment was paid on 19th December  2015. Plaintiff said when 1st Defendant brought a draft agreement…
