SAIDU TANKO HUSSAINI, J.C.A. (Delivering the Leading Judgment): This Appeal is against the Judgment of the High Court of Justice, Borno State delivered on 8th December, 2016 in Suit No. BOHC/MG/CV/001/2015 dismissing the Claim brought before it.
The Appellants instituted action and claimed various reliefs against the respondents in terms of the prayers contained in Paragraph 23 (a) (i) of the Statement of Claim and filed on 24th February, 2015. The claim is for declaration of title to landed property, and for a restraining order against them. The claim was contested.
The appellants claim that they are the representatives of their respective families who laid claim to the land situated at Shuwari Three (3), Bolori district of Maiduguri Metropolitan Council of Borno State covering a area of approximately 255, 000 square metres.
