RULING OF THE COURT

On 12th March 2018, the High Court (Mativo, J) delivered a judgment in Constitutional Petition No. 532 of 2017, which precipitated the two applications now before this Court for determination. The High Court had been moved by the 1st respondent, “Okiya” as the petitioner therein, against the Commissioner General, Kenya Revenue Authority’ “KRA”, the Cabinet Secretary, National Treasury “CS”, and SICPA Securities SOL SA “SICPA” as the 1st, 2nd and 3rd respondents respectively.
