JAMILU YAMMAMA TUKUR, JSC (Delivering the Leading Judgment): The appeal seeks to interrogate the decision of the Court of Appeal Jos Judicial Division delivered on 5th day of July 2005 which affirmed the ruling of the Trial Federal High Court Jos Division delivered on 15th January 1997 in suit No. FCH/J/M108/96 Between Ajuma Olima & Anor and IG Police & Ors wherein the trial court declared that the arrest and detention of the Appellants by the agents of the lst and 2nd Respondents at the instance of the 3rd Respondent (Appellant Herein) on 27/11/96 and the continued arrest and detention of the Appellants as illegal, unconstitutional and unlawful and awarded a total sum of ₦600,000.00k (Six Hundred Thousand Naira) against the Respondents the 3rd Respondent (Appellant Herein) ordered to pay the sum of Five Hundred Thousand Naira (₦500,000.00k) out of the total sum as exemplary damages.
