ADZIRA GANA MSHELIA, J.C.A. (Delivering the Leading Judgment): This appeal is against the Judgment of Plateau State High Court of Justice No. 1 delivered on 7th day of December 2016 in suit No. PLD/J147/2016 by Hon. Justice P.D Damulak Chief Judge.
The Respondent, as plaintiff, sued the Appellant at High Court of Justice, Jos No. 1, vide the writ of summons dated and filed on 23rd March, 2016 under the undefended list procedure, seeking the following reliefs:
1. The sum of N128,000,00.00 (One Hundred and Twenty Eight Million Naira) being the outstanding balance of the sum of N210,000,000.00 (Two Hundred and Ten Million Naira) fixed rate, cumulative deposit due to him and C and J Oil and Gas Nig Ltd.
2. 19.25% interest rate per annum on the sum of N210,000,000.00 (Two Hundred and Ten Million Naira) from 14th February, 2011 to 15th May, 2011 in the sum of N10,106,250 (Ten Million One Hundred and Six thousand, Two Hundred and Fifty Naira).
