TIJJANI ABUBAKAR, J.C.A. (Delivering the Leading Judgment): This is an appeal against the Judgment of the High Court of Lagos State sitting in the Lagos Division, delivered by Bankole-Oki J. on the 10th day of November, 2014 in suit No:LD/1263/2012. The Judgment of the Court is found at pages 238 and 240 of the Records of Appeal wherein the learned trial Judge found in favour of the Claimant and granted his claims as well as damages in the sum of N500,000.00.
The Respondent as Claimant commenced an action against the Appellant claiming several reliefs as per the Writ of Summons and Statement of claim contained at pages 2 - 9 of the records of appeal. The Appellant filed Statement of Defense, parties filed and exchanged pleadings; tendered several exhibits and called their witnesses.
