JIMI OLUKAYODE BADA, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the National Industrial Court of Nigeria, Lagos Division delivered on 16th day of October 2018 in Suit No.: NICN/LA/398/2016 – BETWEEN: MR. VICTOR AJUZIOGU v. SMART MARK LIMITED wherein judgment was delivered in favour of the Claimant i.e. the Respondent in this Court. 

The Claimant now Respondent in this appeal filed an action at the trial Court in which he claimed as follows:- 

“(a) A declaration that suspension of the Claimant is unlawful. 

(b) A declaration that the Claimant’s appointment is still subsisting. 

(c) An order that the Defendant pay the sum of N83,286.93 (Eighty-three Thousand, two hundred and eighty-six naira, ninety-three kobo) for each month from February 2015 till date. 

(d) General damages in the sum of (N1,000,000.00) One Million Naira for financial hardship the Claimant was made to encounter as a result of the actions of the Defendant. 

(e) Cost of this suit”.
