J U D G M E NT
ADJEI,J.A: The present appeal before this Court is an interlocutory appeal filed by the 3rd Defendant/Appellant herein against the ruling of the High Court, Accra, delivered on Wednesday, 29th August 2022. The 3rd Defendant/Appellant filed his notice of appeal against the ruling of the High Court on Monday, 19th September 2022.
The brief facts of the appeal that have culminated in this appeal were that the Plaintiffs sued the Defendants jointly and severally for the following reliefs:
“a. A declaration that the 1st plaintiff is the beneficial owner of the property in the 10.5 kilograms of gold purchased by the 1st defendant with its money or in the alternative, a declaration that 1st plaintiff is the beneficial owner of the amount of US $384,000 used by the 1st defendant in the name of the 2nd defendant company to purchase the gold.
