INTRODUCTION
This is an appeal against the judgment of the Court of Appeal (the lower Court) in appeal No. CA/L/1331/2016 delivered on 18th December 2018. The lead judgment was delivered by Hon. Justice Abimbola Osarugue Obaseki-Adejumo, JCA, with Hon. Justice Anthony Ugochukwu Ogakwu, JCA, and Hon. Justice Ebiowei Tobi, JCA, concurring. In that judgment, the lower Court dismissed the appellant’s appeal against the decision of the Federal High Court (the trial Court), delivered on 4th November 2016 by Hon. Justice J. T. Tsoho, wherein the Court granted the respondent’s claims.
BRIEF BACKGROUND FACTS
The action leading to this appeal was commenced by a Writ of Summons dated and filed on the 28th of March 2014 filed by the Respondent who was the Plaintiff at the trial Court, claiming against the appellant who was the defendant, as follows;
The sum of USD961,771.95 being the total indebtedness of the defendant to the Plaintiff.
