RULING OF THE COURT
1. By way of Notice of Motion dated 26th March 2018, the applicants have moved this Court for certification and leave to appeal to the Supreme Court against the judgment of this Court delivered on 2nd February 2010. The applicants also seek an order for stay of execution of the judgment and decree of this Court pending the hearing and determination of the instant application.
2. The application is supported by the affidavit of Mr. Akberali Karim Kurji deposed on 26th March 2018. The grounds in support are that the intended appeal to the Supreme Court involves a matter of general public importance that transcends the interest of the parties; that the intended appeal raise points of law that rise above the decisions of the High Court and this Court; that the application for certification has been occasioned by a state of uncertainty in law arising from contradictory judgments of this Court; that the intended appeal is not based on mere apprehension of miscarriage of ju…
