DANLAMI ZAMA SENCHI, JCA (Delivering the Leading Judgment): This Appeal is against the Judgment of the High Court of the Federal Capital Territory, Abuja, in Suit No: FCT/HC/2538/2014 delivered on the 16th day of January, 2017 by S. E. Aladetoyinbo J.
By a Writ of Summons filed on the 17th of September, 2014, the Respondents (as Plaintiff) brought an action against the Appellant (as Defendants) under the Undefended List Procedure claiming the sum of N5,250,000.00 (Five Million Two Hundred and Fifty Thousand Naira) only, being rent for the 7 number of flats for the period of one (1) year from 30/8/2014 to 30/8/2015. See pages 1 - 15 of the Record.
In response, the Appellant who was the Defendant at the Trial Court filed a Notice of Preliminary Objection challenging the competence of the suit as well as the Notice of Intention to Defend and an Affidavit in support of same both dated 28th September, 2015.
