ONYEMENAM, J.C.A. (Delivering the Leading Judgment):This is an appeal against the ruling of the High Court of Plateau State delivered on 13th February 2019, wherein the trial court admitted the 1st - 7th respondents, who are charged with culpable homicide punishable with death, to bail pending trial.
The respondents, amongst others, were arraigned on an amended charge filed on 23rd January 2019, for various offences connected with the murder of Major General Idris Alkali (Rtd.).The 1st - 7th respondents who are charged with culpable homicide punishable with death under section 221 of the Penal Code Laws of Northern Nigeria, filed an application at the trial court for bail pending trial while the prosecution opposed the application. In its ruling delivered on 13th February 2019, the trial court granted bail to the 1st - 7th respondents. See page 119 of the record.
