ADAH, J.S.C. (Delivering the Leading Judgment): This appeal emanated from the judgment of the Court of Appeal, Enugu Judicial Division, in Appeal No: CA/E/127C/2018, delivered on the 1st day of August, 2019. It is a case of murder wherein the Ebonyi State High Court convicted the respondent and others for the death of one Ali Agha. Upon appeal to the lower court, the lower upturned the sentence and conviction of the respondent.
Aggrieved with the decision of the lower court, the appellant filed an appeal to this court.
The facts of this case from the records are captured as follows:
A meeting of the Amorie Ozizza Youths in Afikpo North Local Government Area of Ebonyi State was convened for the 18th day of September, 2016. Several youths were absent and the Chairman of the Amorie Ozizza Youths, Ogbonna Egwu, instructed the taskforce unit of the group to move around the village and compel those absent to attend the meeting.
