JAFARU MIKA'ILU, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of Akwa Ibom State delivered on 8th April 2008. The judgment was entered under the undefended list for the Plaintiff/Respondent. The Plaintiff/Respondent claimed against the defendant/appellant the sum of N1,500,000.00 (one million, five hundred thousand naira) by writ of summons placed under the undefended list.
