An order declaring the record of appeal compiled and transmitted to this honourable court by the registrar of the lower court as incomplete in view of the missing ruling of the honourable trial judge delivered on 10 November 2004 in respect of the appellant’s application dated 29 November 2004 and 4 November 2004. An order affirming that the honourable trial judge, K. A. Jimoh refused the appellant’s said application dated 29 November 2004 and 4 November 2004 in suit No. 1/178/2000 on the ground that he is functus officio and cannot set aside his own order closing the case of the applicant. An order adopting the applicant’s counsel’s file notes of the ruling of the honourable trial court annexed as exhibit B.0.5 as forming part of the record for the purpose of this appeal.
