FREDERICK OZIAKPONO OHO, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of Kebbi State sitting at Zuru in Suit No. KB/ZR/HC/7CV/2012 delivered on the 2-2-2017 in which the Court below dismissed the suit of the appellant herein who was the claimant while the 1st respondent was the defendant to a writ of summons dated and filed 20-4-2012 and later amended on the 13-6-2014 wherein the appellant as claimant claimed against the 1st Respondent as per paragraph 14 of the said statement of claim as follows;
WHEREOF the claimant is aggrieved and prays this Court for the following;
1. A declaration that the claimant is the rightful owner of the land in dispute and who is entitled to the statutory right of occupancy on behalf of late Bakh Dazi Family,
2. A declaration that the continued stay of the 1st defendant constitutes an act of trespass,
3. And any such further order as this Court may deem to make in the circumstances.
