PETER OLABISI IGE, J.C.A. (Delivering the Leading Judgment): This appeal is against the decision of the Federal Capital Territory High Court contained in the judgment delivered by Hon. Justice UGOCHUKWU A. OGAKWU (now JCA) on Thursday, 26th day of July, 2012 against the Appellant and one other person.

The Appellant and one BATURE AUDU (M) were arraigned before the said Court for the following offences:-

"1. That you Babangida Sule and Bature Audu (M) on or about the 13th day of June 2007 in Wuse II, Abuja FCT within the Abuja Judicial Division conspired to do an illegal act to wit you agreed to rob Messr Ismaila Muazu, Mulugeta Abebe and Charles Oguamanam, which act was done in pursuance of the agreement and you thereby committed an offence punishable under Section 97 of the Penal Code.

2. That you Babangida Sule and Bature Audu (A) on or about the 13th' day of June 2007 in Wuse II, Abuja Judicial Division while armed with locally made pistol robbed Messr Ismaila kluazu, Mulugeta Abebe a…
