IDRIS, J.S.C. (Delivering the Leading Judgment): This is an appeal against the judgment of the Court of Appeal, Akure Judicial Division, in Appeal No. CA/AK/102C/2012, delivered on the 5th day of December, 2013, by Justice Sotonye Denton West, JCA (PJ), Justice Mojeed A. Owoade, JCA, and Justice C. Ifeoma Jombo-Ofo, JCA, wherein the Court of Appeal upheld the conviction of the appellant; however, the lead judgment varied the sentence imposed by the High Court of Osun State, Ilesa Division, in Charge No. HIL/1C/2008, wherein the appellant was convicted and sentenced to death by hanging.

The appellant, along with others who remain at large, was arraigned before the High Court of Osun State on an amended five-count charge on crimes of conspiracy, armed robbery, and murder.
