OYEBISI FOLAYEMI OMOLEYE, J.C.A. (Delivering the Leading Judgment): This is an appeal against the Ruling of the High Court of Gombe State sitting in Gombe Judicial Division (hereinafter called the trial Court) per, Awak, J., delivered on 26th February, 2016 in Suit No. GM/178/2014.
The Appellant who was the plaintiff at the trial Court per his Writ of Summons and Statement of Claim sued and claimed against the four Respondents herein as defendants jointly and severally for the following:
i. A Declaration that the Defendants letter dated 21st March, 2014 and circulated to the public constituted defamation.
ii. A Declaration that the Defendants do not have any justifiable right, bases or reasons whatsoever to have issued or caused the libellous letter dated 21st March, 2014 to be circulated to the public.
iii. A Declaration that the Defendants do not have any legal bases to direct the Plaintiff to vacate his office as DDA Chairman/President.
