ELIAS, CJN (Delivering the Leading Judgment): The plaintiff claimed in Suit No. LD/627/72 an injunction restraining the defendant, its servants or agents from committing a breach of their Contract of Employment with the plaintiff. Adedipe, J., gave judgment in favour of the plaintiff in the High Court of Lagos State on March 23, 1973.
The facts may be stated briefly as follows. The plaintiff was interviewed by a panel of the Family Planning Council of Nigeria on March 28, 1972. In a letter dated March 29, 1972, the Chairman of the interviewing panel wrote a letter to the Secretary directing him to make an offer of appointment to the plaintiff as National Clinic Administrator with effect from April 1, 1972. A copy of this letter was sent by the Chairman of the panel to the plaintiff. The Secretary did not, however, write any letter to the plaintiff.
