i. Introduction:

[1] My Lords, the Respondents in this appeal, Kwame Amponsah and Christopher Obareke, together with five other persons, were charged with one count of conspiracy to commit the offence of defrauding by false pretence and one count of defrauding by false pretence, contrary to sections 23(1) and 131 of the Criminal Offences Act. They were also charged with one count of money laundering contrary to section 1 of the Anti-Money Laundering Act, 2008 (Act 749).

[2] The prosecution called two witnesses in proof of its case, without calling the complainant to testify. The Respondents were convicted by the trial High Court, which sentenced them to 24 months’ imprisonment with hard labour (IHL), in addition to a fine of 3,000 penalty units or, in default, an additional four years’ imprisonment on counts one and two and 2,000 penalty units or, in default, two years’ imprisonment on count three.
