RULING ON MINI TRIAL

THE ANTECEDENTS OF THE CASE

This is a ruling in a mini trial to determine the admissibility of both the Investigation and Charged Cautioned Statements of the Accused person herein. The Court has considered in its ruling the submission filed by counsel for the Republic/Respondent which has been most beneficial.

The Accused person was first arraigned before this Court on the 25 of October 2022.  Per the Bill of Indictment filed on the 18 August 2022, the Accused person was charged with one (1) count of Murder contrary to Section 46 of the Criminal Offences Act, 1960 (Act 29).

 FACTS OF THE CASE

In the opening address of the Prosecution to the jury, the facts provided were that, on the 3 November, 2021 at about 4:30am, a dispute arose between the Accused person and her deceased husband, Kwaku Gyasi.
